Wedding Video and Photography Agreement Form for Bride and Groom
This agreement is between the bride and groom who fill in the form at the bottom hereinafter referred to as the "Client", and Roll Camera, hereinafter referred to as the "Videographer", and Emily Grace Photography, hereinafter referred to as the 'Photographer'. Entire Agreement: This agreement contains the entire understanding between the Clients, the Videographer and the Photographer. Confirmation: A submitted “Wedding Video and Photographer Agreement Form” and payment of the booking fee/deposit are necessary to confirm the stated wedding services from the Videographer and Photographer. Photography: The scope of the photography coverage is detailed in the 'Wedding Photography Checklist' which is annexed hereto and forms part of this Wedding photography contract. Additional charges for extra photography time on the wedding day shall be charged at $100 NZD per hour, and shall become payable within 14 days of presentation of an invoice by the Photographer. Additional photographs requested beyond that detailed on the Wedding Photography Checklist shall be quoted for and paid on order. If the Photographer resigns this assignment for reasons such as changes made by the Client to the venue, dates or time, non-payment of fees or non-performance by the Client, monies paid shall be refunded after deductions for travelling costs incurred and services performed up to that time, charged at $100 per hour. Pre-Wedding Consultation: This normally happens at the time of booking or a month prior to the wedding. The Clients will outline broadly what is required and the Videographer and Photographer will advise on planning, logistics and timings where needed. If required, the Clients are welcome to pop in for an additional chat closer to the time of the wedding to iron out the remaining details. In any case we will contact you a few days before the wedding to ensure that there have been no last minute changes that may effect how we operate. The photographer may consult separately to ensure the best communication and planning for the day. Cooperation: The Clients, Photographer and the Videographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. We recommend that the Videographer/Photographer be provided with a helper (additional contact) who will point out key individuals to be filmed. The Clients also agree to give the Videographer and Photographer sufficient warning of key events at the wedding to give the Videographer time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at weddings like having to be filmed / photographed. In such cases the Videographer and Photographer will use their discretion but cannot be held responsible for a lack cooperation. The Schedule: Our shooting schedule, style of working and experience are designed to achieve a great set of photos and wedding video for the Clients, accomplished with good humour and enjoyed by all concerned. Both the Clients, Photographers and the Videographers therefore agree that punctuality and cheerful cooperation are essential to producing outstanding results. In cases where the wedding does not run on time (for example, extreme lateness by one of the Clients arriving to the church) we cannot guarantee to take our normal set of videos or photos although in such circumstances we will do our absolute best to compensate. Production - The client can be assured that Roll Camera Limited will make time to go over the schedule with the couple before the day to ensure their as prepared as possible to capture every important moment discussed at the wedding. Roll Camera Limited often expect their to be slight schedule changes during the wedding day, and sometimes spontaneous events and actions that are important to capture. We will make every effort to accommodate these changes and capture all of the important moments discussed and more. In the unlikely case that a particular segment of the wedding is either not recorded, partially recorded, or recorded unacceptably due to an equipment or Videographer error, Roll Camera Limited will not be held liable. However, if an entire segment of your wedding video is missing that was arranged to be recorded e.g. the entire ceremony, a refund or partial refund may be discussed as appropriate and liability is limited entirely to fee paid for the agreed service. Roll Camera Limited shall not be held liable for injury or damages exceeding the value of this agreement and limits any liability for loss, damage, or failure to deliver the videos, for any reason to the return of all payments previously made. The client agrees that no further legal action will be pursued. Lighting - In order to ensure quality footage, every effort must be made to have the lighting at all locations set to a level acceptable where possible. Roll Camera Limited reserves the right to request changes in lighting levels at event locations, this is entirely up to the client to accept or decline but the outcome may effect the quality of footage Roll Camera Limited to be able to capture. Failure to accommodate lighting requirements may cause grainy and unclear video. Paparazzi Wedding Guests: Some of your guests may have digital cameras or smart phones and may also want to film/photograph the Clients. In the spirit of cheerful cooperation, the Clients agree to give the Videographers & Photographers precedence over the guests in order to film and photograph the required content for the wedding services described above. House Rules: Note the Videographers and Photographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example, some ministers insist that no filming is allowed, and others will insist that the videographer/photographer shoot from a specific location. In such circumstances the Clients agree to accept the technical limitations that may be imposed on the equipment used. We advise the Clients to make themselves aware of the rules of the venue concerned and if necessary negotiate with the personnel concerned. Copyright Law: The copyright of video footage remains with the Videographer, and the photographs with the Photographer. The Videographer and Photographer grants the Clients permission to make copies of the images under the following conditions. The video taken by the Videographer and the photos taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication or any Commercial use of videos or photos is not allowed without prior written permission from the Videographer or Photographer specifically. The Photographer and Videographer shall not be liable for any claims whatsoever resulting from alterations made to the material by the Client. The Photographer grants the Client the right to make unlimited number and format of copies of the photographs in any medium and for personal use. Model Release: The Clients grant the Videographer and Photographer and their legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the videos and photographs of the Clients for editorial, competition, advertising and any other purpose and in any manner, to alter the videos without restriction; and to copyright the video. The Clients hereby release the Videographer and Photographer and their legal representatives, heirs and assigns from all liability and claims in connection with the images. Limit of Liability: If the Videographer or Photographer is too ill or becomes injured and cannot supply the wedding services specified above the Videographer/Photographer will try to book a replacement. If a second Videographer or Photographer is unavailable and a replacement cannot be found, then liability is limited to a refund of any payments received. The Videographers and Photographers have working methods in place to prevent loss or damage to your video and photos. However, there is the unlikely possibility that video/photos may be lost, stolen or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied. Act of God: All monies shall be refunded and this agreement shall become null and void if an act of God or other catastrophe necessitates cancellation, or in case of death or serious illness to either part or their immediate families up to five days before the wedding. Such cancellation must be in writing and a registered professional shall attest to the illness or death referenced as the reason for cancellation. Booking Fee/Deposit: In the event of the Clients cancelling the wedding for whatever reason the booking fee is non-refundable. It will be considered as liquidated damages to the Videographer & Photographer. This Agreement shall be construed, interpreted and governed in accordance with the laws of New Zealand and should any provision of this Agreement be judged by an appropriate court as invalid, it shall not affect any of the remaining provisions whatsoever. We have understood the contents of this contract and agree to the terms therein.
